RE: The tariff classification of Christmas tree ornaments from Hong Kong.

Dear Mr. Reuben:

In your letter dated December 19, 2001, on behalf of your client Focus International, you requested a tariff classification ruling.

Sample number one is box shaped and decorated like a Christmas tree. The exterior is covered with green satin fabric. The top of the box is decorated with beads. This box measures 3-1/4” x 3-1/4” x 1-1/4”. Sample number two is a box in the shape of a five-pointed star. The box is covered with gray satin fabric on the exterior. It is decorated with a pattern of beads. This box measures approximately 2-1/4” radius by 1-1/2” in height. Your letter of inquiry states that both boxes will be empty on importation. You further state that they will be filled with candies after importation. A string is attached to the top of the boxes for the purpose of hanging on the Christmas tree or used as stocking stuffers.

The samples are returned as you requested.

The applicable subheading for the Christmas tree and five-pointed star shaped boxes will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
