RE: The tariff classification of threaded fasteners from Taiwan.

Dear Mr. Neriah:

In your letter dated July 13, 2001, submitted on behalf of your client, Toshiba America Information Systems, Inc., you requested a tariff classification ruling.

You have described your samples, part #K0811460 and part #K0811470, as threaded fasteners. You stated that part #K0811460 is a threaded fastener with a threaded male shank (2.5mm diameter) on one end, a hexagonal shaped flange in its center, and a threaded tapped female opening (2.0mm diameter) on the other end. It is used to both secure a motherboard to the cabinet, and to create a threaded opening to secure the fan/heat sink assembly over the motherboard. The product is made of steel. You also stated that part #K0811470 is a non-self-tapping, nickel coated non-stainless steel screw with a stainless steel spring wrapped around the screw shank. The diameter of the screw’s shank is 2.0mm. The screw is used to fasten in place the fan/heat sink assembly over the motherboard. The heat sink on the fan/heat sink assembly actually makes physical contact with the top surface of the CPU processor integrated circuit. The heat sink has a conductive material, which draws heat away from the CPU. While the screw holds the fan/heat sink assembly in place over the motherboard and secured to the cabinet, the function of the spring is to apply a constant pressure down to assure physical contact of the heat sink with the CPU. The screw is inserted into the female opening of part #K0811460.

The applicable subheading for part #K0811460 will be 7318.19.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers and similar articles, of iron or steel: threaded articles: other. The duty rate will be 5.7% ad valorem.

The applicable subheading for part #K0811470 will be 7318.15.6060, HTS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers, (including spring washers) and similar articles of iron or steel: threaded articles: other screws and bolts, whether or not with their nuts or washers: having shanks or threads with a diameter of less than 6 mm: other. The duty rate will be 6.2% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
