RE: The tariff classification of dehumidifiers from Korea

Dear Mr. Huber:

In your letter dated July 10, 2001 you requested a tariff classification ruling.

With your inquiry you submitted literature and a specification sheet for three models of household dehumidifiers used to remove moisture from air which is drawn in through the units. These machines basically consist of a wheeled metal housing containing an air intake grille, washable air filter, evaporation coils, two-speed fan powered by an electric motor, automatic defroster control, removable water tank, and top-mounted control panel. The control panel features an adjustable humidistat for regulating the humidity of the air. The tank, which collects the water removed from the air, may be manually emptied or continuously drained by means of an external drain connector. The units automatically shut off when the tank is full. The specifications of the particular models about which you inquired are:

Heading 8509 encompasses electromechanical domestic appliances, with self-contained electric motor. Note 3(b) of Chapter 85 states that this heading covers certain machines provided the weight of such machines does not exceed 20 kilograms, exclusive of extra interchangeable parts or detachable auxiliary devices. Accordingly, the applicable subheading for models AHG40LB and AHG50LB, which each weigh less than 20 kilograms, will be 8509.80.0095, Harmonized Tariff Schedule of the United States (HTS), which provides for electromechanical domestic appliances, with self-contained electric motor: other appliances: other. The rate of duty will be 4.2 percent ad valorem.

The applicable subheading for model AHG30LA, which weighs over 20 kilograms, will be 8479.89.1000, HTS, which provides for machines and mechanical appliances having individual functions, not specified or included elsewhere (in Chapter 84): other machines and mechanical appliances: other: electromechanical appliances with self-contained electric motor: air humidifiers or dehumidifiers. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
