RE: The tariff classification of “Blue Ice” sports bottles from Malaysia.

Dear Ms. Jones:

In your letter dated May 30, 2001, on behalf of Rubbermaid Home Products Inc., you requested a tariff classification ruling.

Two samples were provided with your letter. The sports bottles are composed of plastics. They have an insulating cover made from nylon fabric backed with foamed plastics. The cover has an adjustable webbed shoulder strap. A three compartment packet of “Blue Ice” brand ice substitute fits between the bottle and the insulating cover. The “Blue Ice” packet is designed to be stored in the freezer and then placed around the bottle to keep the contents cold. The bottles will be imported in two sizes: 1 quart and 1.25 pints. There is a plastic cap at the top which may be removed when refilling the bottle. The cap incorporates a flip top lid that may be opened to uncover a small opening when drinking.

The applicable subheading for the “Blue Ice” sports bottles will be 3926.90.9880, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics, other. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
