RE: The tariff classification of Large Glow Candles from China.

Dear Mr. August:

In your letter dated May 24, 2001, you request a tariff classification ruling.

The sample and photographs that you submit, Item #8380, Large Glow Candles, are two designs of wax-filled containers: Human Eye and Spider Web. The Human Eye consists of a white colored candle poured into a white colored sphere shaped wax container that measures approximately 3-1/2” in diameter and is decorated with two molded blue eyes that measure approximately 2-1/2” in diameter. The Spider Web consists of an orange colored candle poured into an orange colored sphere shaped wax container that measures approximately 3-1/2” in diameter and is decorated with a molded spider and spider web. Both designs of glow candles will be imported in additional colors.

The applicable subheading for Item #8380, Large Glow Candles (Human Eye and Spider Web), will be will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for Festive, carnival or other entertainment articles,....Other: Other: Other. The rate of duty will be free.

You have asked whether this product is subject to antidumping duties or countervailing duties. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
