RE: The tariff classification of photographic optical filters

Dear Mr. Marcus:

In your letter dated May 1, 2001, you requested a tariff classification ruling. A sample of a photographic optical filter was submitted with the ruling request.

The submitted sample is a round red photographic optical filter that measures approximately 1 3/4 inches in diameter and has a thickness of approximately 1/16 inch. You indicate in your letter that some of the photographic optical filters may be like the submitted sample, and others may differ slightly in size, thickness, color or shape (may be square or rectangular). You state that the photographic optical filters may be imported from China.

Your sample is being returned as requested.

The applicable subheading for the photographic optical filters will be 9001.90.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for lenses (including contact lenses), prisms, mirrors and other optical elements, of any material, unmounted, other than such elements of glass not optically worked; other; other; other. The rate of duty will be 2.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
