RE: The tariff classification of three cotton/polyester and polyamide/polyester/cotton blend weft knit fabric from the Netherlands.

Dear Mr. Schrader:

In your letter dated January 26, 2001, on behalf of your client Burlington Industries, Inc., you requested a tariff classification ruling.

Three samples of knit fabric accompanied your request for a ruling. The submitted sample, designated as style 50314, is a weft knit fabric composed of 60% polyamide, 20% polyester and 20% cotton. Weighing approximately 600 g/m2, this fabric will be imported in 210 to 225 centimeter widths. It is characterized by a double knit construction and contains polyamide fiber inserted during the knitting process between the layers of knit fabric. This “stuffing fiber” provides the fabric with extra bulk and cushioning. Your correspondence indicates that this product will be used as mattress ticking.

Style 50310 is a knit pile fabric composed of 65% cotton and 35% polyester. The pile, which you indicate is formed by the insertion of cotton sliver during the knitting process, is wholly composed of cotton. Weighing approximately 365 g/m2, this fabric will be imported in 210 centimeter widths. Your correspondence indicates that this product will be used as mattress ticking.

Style 50308 is a weft knit fabric of double knit construction. It is composed of 75% cotton and 25% polyester. Weighing approximately 236 g/m2, this product will be imported in 210 centimeter widths. It is characterized by a printed fleur de lis motif. Your correspondence indicates that this product will be used as mattress ticking.

The applicable subheading for the knit fabric designated as style 50314 will be 6002.93.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for other knitted or crocheted fabrics, other, of man-made fibers, of double knit or interlock construction, of nylon. The rate of duty will be 11.2 percent ad valorem.

The applicable subheading for the knit fabric designated as style 50310 will be 6001.10.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for pile fabrics, including “long pile” fabrics and terry fabrics, knitted or crocheted, “long pile” fabrics, other. The rate of duty will be 9.6 percent ad valorem.

The applicable subheading for the knit fabric designated as style 50308 will be 6002.92.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for other knitted or crocheted fabrics, other, of cotton, other. The rate of duty will be 11.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
