RE: The tariff classification of an athletic support protector, a pelvic protector and a goalie cup protector from Canada.

Dear Mr. Ralston:

In your letter dated December 29, 2000, you requested a tariff classification ruling, on behalf of Bauer Nike of Montreal Canada, your client.

You are requesting the tariff classification on three separate items of protective equipment designed to be used in the game of hockey to protect the body from injury that may be caused by a hockey puck, hockey sticks, etc. The three products are described as follows: an athletic support protector, a pelvic protector and a goalie cup protector. The three items are constructed of hard plastic with textile coverings and textile attachments in the case of the pelvic protector and the goalie cup protector, and hard plastic with textile attachments only in the case of the athletic support protector. The samples will be returned, as requested.

The applicable subheading for the athletic support protector, the pelvic protector and the goalie cup protector will be 9506.99.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Articles and equipment for general physical exercise, gymnastics, athletics, other sports...outdoor games...parts and accessories thereof: Other...Other.” The rate of duty will be 4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
