RE: The tariff classification of Buprenorphine Hydrochloride (CAS-53152-21-9), imported in bulk form, from the Czech Republic

Dear Ms. Mauro:

In your letter dated January 12, 2001, you requested a tariff classification ruling.

The subject product, Buprenorphine Hydrochloride, is a semisynthetic derivative of Thebaine, a naturally occurring alkaloid found in opium. It is indicated for use as an analgesic drug.

The applicable subheading for Buprenorphine Hydrochloride, imported in bulk form, will be 2939.10.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for "[A]lkaloids of opium and their derivatives; salts thereof: Other: Synthetic." The rate of duty will be free.

This merchandise may be subject to the requirements of the Controlled Substances Act and/or the Controlled Substances Import and Export Act, which are administered by the Drug Enforcement Administration (DEA).
