RE: The tariff classification of a heart shaped candle and an aluminum dish from China.

Dear Ms. Hubbard:

In your letter dated November 6, 2000, you request a tariff classification ruling.

The sample that you submit, Style #036-2102, Heart Shaped Candle, consists of a white and pink colored heart shaped scented pillar candle that measures approximately 6" in height and 4" across its widest point, and a heart shaped aluminum dish that measures approximately 3/4" in height and 6-1/2" across its widest point.

In our opinion, Style #036-2102, Heart Shaped Candle, is not a set for Customs purposes. Therefore, the candle and aluminum dish are classified separately.

The applicable subheading for will be 3406.00.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Candles, tapers and the like. The rate of duty will be free.

The applicable subheading for the aluminum dish will be 7615.19.9000, HTS, which provides for table, kitchen or other household articles and parts thereof, of aluminum, other, other. The rate of duty will be 3.1% ad valorem.

The Department of Commerce has determined that petroleum wax candles in the following shapes: tapers, spirals, and straightsided dinner candles; rounds, columns, pillars, votives; and various waxfilled containers are within the scope of the antidumping duty order on petroleum wax candles from China. In our opinion, Style #036-2102, Heart Shaped Candle, is within the scope of the antidumping duty order on petroleum wax candles from China.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
