RE: The tariff classification of plastic sheet from Australia.

Dear Mr. Horowitz:

In your letter dated October 27, 2000, on behalf of Toobs, Inc., you requested a tariff classification ruling.

Three samples were provided with your letter. The first sample is identified as “Surlyn laminated to polyethylene foam.” It consists of noncellular sheets of polyethylene plastic laminated to cellular sheets of polyethylene. The second sample is identified as “Surlyn laminated to polypropylene foam.” It consists of noncellular sheets of polyethylene plastic laminated to cellular sheets of polypropylene. The third sample is identified as “Marlyn laminated to polypropylene foam.” It consists of noncellular sheets of polypropylene plastic laminated to cellular sheets of polypropylene. In all three types of sheets, the cellular component is less than 17 percent of the product by weight.

The applicable subheading for the above products will 3921.19.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other plates, sheets, film, foil and strip, of plastics: cellular, other. The rate of duty will be 6.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
