RE: The tariff classification of rubber sponge from Korea.

Dear Ms. Kwok:

In your letter dated August 29, 2000, you requested a tariff classification ruling.

The submitted sample of a rubber sponge is identified as item C3-57639. Your letter of inquiry states that this butadiene rubber sponge will be used as a promotional item. You also requested information concerning countervailing or antidumping duties. This product is not subject to any countervailing or antidumping duties.

The applicable subheading for the butadiene rubber sponge will be 4016.99.0500, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of vulcanized rubber other than hard rubber: household articles not elsewhere specified or included. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
