RE: The tariff classification of hardware from the United Kingdom

Dear Ms. Benson:

In your letter dated August 10, 2000, on behalf of HAF, you requested a tariff classification ruling.

The merchandise is a variety of hardware, illustrated in a catalog of handles and fittings. Normally, ruling requests should contain a maximum of 5 items in order to be accepted. However, since many of the items in this request are of the same class or kind, we can supply classifications for most of them. Any article not classified may be resubmitted in another request.

The various door hinges, including lift-off, fixed pin, projection, rising-and-falling, cabinet, butt and ball bearing hinges, are made of steel.

The applicable subheading for the lift-off, fixed pin, projection, rising-and-falling, butt and ball bearing hinges will be 8302.10.6030, Harmonized Tariff Schedule of the United States (HTS), which provides for hinges, of iron or steel, of aluminum or of zinc, suitable for interior and exterior doors. The rate of duty will be 3.5 percent ad valorem.

The applicable subheading for the cabinet hinges will be 8302.10.6060, Harmonized Tariff Schedule of the United States (HTS), which provides for hinges, of iron or steel, of aluminum or of zinc, suitable for furniture or cabinets. The rate of duty will be 3.5 percent ad valorem.

The lever and pull handles come in various styles, including: Steel Tech, Modis, Flare, Shape, Mellerio, Tactil, Plane, Forme, Wing and Deco. They are made of steel or brass, and are not dedicted to a particular use with keyed locks.

The applicable subheading for the steel handles will be 8302.41.6015, Harmonized Tariff Schedule of the United States (HTS), which provides for other mountings, fittings and similar articles, suitable for buildings, other, of iron or steel, of aluminum or of zinc, suitable for interior and exterior doors, door pulls. The rate of duty will be 3.9 percent ad valorem.

The applicable subheading for the brass handles will be 8302.41.9015, Harmonized Tariff Schedule of the United States (HTS), which provides for other mountings, fittings and similar articles, suitable for buildings, other, other, suitable for interior and exterior doors, door pulls. The rate of duty will be 3.5 percent ad valorem.

The catalog shows a number of mortise locks, including sash locks, deadbolts, and latches. Some are key-operated, and others, such as the bathroom lock and mortice latch, are not. The catalog also shows a number of window fittings of steel, including window handles, casement fasteners, and casement stays.

The applicable subheading for the key-operated locks will be 8301.40.6030, Harmonized Tariff Schedule of the United States (HTS), which provides for padlocks and locks (key, combination or electrically operated), of base metal, other locks, other, door locks. The rate of duty will be 5.7 percent ad valorem.

The applicable subheading for the non-key-operated locks and latches will be 8302.41.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for other mountings, fittings and similar articles, suitable for buildings, other, of iron or steel, of aluminum or of zinc, suitable for interior and exterior doors, other. The rate of duty will be 3.9 percent ad valorem.

The applicable subheading for the window fittings will be 8302.41.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for other mountings, fittings and similar articles, suitable for buildings, other, of iron or steel, of aluminum or of zinc, other. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
