RE: The tariff classification of tote bag from China.

Dear Mr. Epstein:

In your letter dated August 15, 2000, on behalf of Avon Products, Inc., you requested a tariff classification ruling for a tote bag.

The sample submitted is identified as a “Carry-All Foldable Tote Bag” – PP 213896. The item is a shoulder tote manufactured with an exterior surface of polyvinyl chloride (PVC) designed to contain accessories and personal effects during travel. The bag is unlined with no additional features. The bag is foldable for storage and in its folded position it measures approximately 10 ¾” x 8”. In its unfolded position the bag measures approximately 25”(W) at the top and tapers to a base width of approximately 15”(W) and16”(H). The top of the bag is secured by means of a flap with a snap fastener. Your sample is being returned as requested.

The applicable subheading for PP 213896 will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
