RE: The tariff classification of two decorative glass articles from China

Dear Ms. Benway:

In your letter dated July 31, 2000, on behalf of your client, Ocean State Jobbers, you requested a tariff classification ruling. A representative sample of the item was submitted with your ruling request.

The submitted samples, which are identified as “Snuff Bottles”, are two decorative hand-painted glass bottles depicting an oriental scene. One bottle is round (item #08485) and measures approximately two and one-half inches in height by two and one-half inches in width; the other bottle is oval (item #08486) and measures approximately three inches in height by one inch in width. Each bottle has a removable glass lid with a foam stopper.

You indicated in your letter that the unit value of each glass snuff bottle is $0.60.

The applicable subheading for the two decorative glass snuff bottles will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes: other glassware: other: other: valued over $0.30 but not over $3.00 each. The rate of duty will be 30 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
