RE: The tariff classification of yarn, cord, and ribbon from Indonesia.

Dear Mr. Evans:

In your letter, undated but received by us on July 28, 2000, you requested a classification ruling.

You submitted three samples. The first is a metal wire covered by two strips of metallized yarn held together with a knit stitch by a monofilament yarn. The metallized strips give a chenille effect. It is labeled “material content: polyester.”

The second sample is a spool of metallized cord, identified as #3005 / 3 RL TIN X 60’ / $1.288.” The spool contains three lengths of metallized cord, each composed of a core of twisted fibers sheathed in braided metallized thread. One length is red, one gold, and one green.

The third sample is piece of narrow woven fabric, approximately 1½” in width, with each edge secured by a wire which is covered by a metallized yarn giving the wire a chenille effect.

The applicable subheading for the polyester wire will be 5607.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Twine, cordage . . . of other synthetic fibers, . . . Other.” The duty rate will be five percent ad valorem.

The applicable subheading for the metallized cord #3500 will be 5605.00.9000, HTS, which provides for “Metallized yarn . . ., combined with metal in the form of thread, strip, . . . or covered with metal: Other.” The duty rate will be 13.9 percent.

The applicable subheading for the narrow fabric will be 5806.32.1090, HTS, which provides for “Narrow woven fabrics . . .: other woven fabrics: of man-made fibers: ribbons: Other.” The duty rate will be 7.2 percent.

HTS 5605.00.9000 falls within textile category designation 201. HTS 5607.50.4000 falls within textile category designation 669. HTS 5806.32.1090 falls within textile category designation 229.

Based upon international textile trade agreements products of Indonesia are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
