RE: The tariff classification of a “Pac-Lite Bivy Sack” from China.

Dear Ms. Beegle:

In your letter dated July 13, 2000, on behalf of Cabela’s Inc., you requested a tariff classification ruling. The sample is being returned as requested.

The sample submitted is a “Pac-Lite Bivy Sack”, item number I A-51-4200. It is a sleeping bag stated to be made of waterproof coated nylon woven fabric for protection against the elements. It is sewn closed on three sides with one of the sides featuring a zipper. There is no filling material between the fabrics. The article features a drawstring hood at one end and a permanently attached zippered pouch on the bottom side which enables the item when not in use to be folded and stuffed into the zippered pouch.

The applicable subheading for the “Pac-Lite Bivy Sack” will be 6306.99.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for camping goods: Other: Of other textile materials. The rate of duty will be 6.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
