RE: The tariff classification of textile beam flanges from South Korea

Dear Mr. Mazur:

In your letter dated June 7, 2000 you requested a tariff classification ruling.

The textile beam flanges are composed of forged aluminum alloy 6061-T6 and weigh 113.5 pounds (51.5kg) each. Each flange has a 30 ¼” diameter (762mm) with an 11 ¼” diameter hub approximately 2 ¾” high in the center. In their imported condition, the beam flanges are “un-machined”. They will be further processed in the United States, e.g., contoured machined by a CNC horizontal lathe, for use as components of textile warp beams. Two flanges and a connecting aluminum-alloyed barrel are assembled together to form one warp beam. The assembled beam is then polished and can receive special anodized finishes and custom markings as required.

During a telephone conversation with a member of my staff, you explained that each flange is machined for use with a specific textile warping (winding) or knitting machine depending upon the customer’s specifications. However, you indicated that the flanges are principally used with knitting machines.

The applicable subheading for the textile beam flanges will be 8448.59.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for Auxiliary machinery for use with machines of heading 8444, 8445, 8446 or 8447 ( for example, dobbies, Jacquards, automatic stop motions and shuttle changing mechanisms); parts and accessories suitable for use solely or principally with the machines of this heading or of heading 8444, 8445, 8446 or 8447 (for example, spindles and spindle flyers, card clothing, combs, extruding nipples, shuttles, healds and heald-frames, hosiery needles): Parts and accessories of machines of heading 8447 or of their auxiliary machinery: Other: Parts of knitting machines. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
