RE: The tariff classification of a carrying bag from China, Thailand and/or Philippines.

Dear Ms. Dawson:

In your letter dated April 5, 2000, you requested a classification ruling for a carrying bag.

The sample submitted is identified as style 41906, UPC 047406-03474-1. It is a carrying bag manufactured of panels constructed of a three-layer construction of an exterior of nylon textile fabric, a middle layer of 1/4" foamed plastics and a backing of nylon textile materials. The bag body consists of a main panel and one end panel. The top closure is a panel constructed the same as the main body and a nylon coil zipper which extends around three sides. The bottom panel consists of an exterior of Polyvinyl Chloride (PVC) plastic sheeting, a foamed plastic middle and nylon backing. The panels are sewn and bound with tape to form the bag that measures approximately 11" wide x 8" high and 4" deep. The bag is not waterproof. It has a woven polypropylene (PP) yarn shoulder strap. The front of the bag has a form fitted pocket which measures approximately 9" wide, 6" high and 1 1/2" deep. The pocket appears to be of a kind a specially shaped towelette dispenser is often inserted and for use with baby bags.

Item 41906 is essentially a baby bag designed and chiefly used to be a carry all organizer for a baby's personal effects and accessories including food and other infant preparations necessary for personal care. The bag is not chiefly used for the preparation, serving or storage of food or beverages.

The applicable subheading for style 41906 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 18.6 percent ad valorem.

HTS 4202.92.3031 falls within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. Products of Thailand and Philippines are subject to the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
