RE: The tariff classification of women’s knit wear apparel from Hong Kong

Dear Mr. Rodriguez:

In your letter dated April 12, 2000, on behalf of Mark Group, Inc., you requested a tariff classification ruling.

The submitted sample, style BPK9875, is a woman’s 2 piece set which you call a ‘slip dress”. The set is comprised of two women’s knit dresses. The inner dress is constructed from 90% polyester, 10% spandex, knit fabric and is tacked stitched (not permanently attached), at the neck and the armholes of the outer dress. The outer dress is constructed from 40% nylon, 36% mohair, 24% acrylic, knit fabric. Both dresses feature spaghetti straps and straight front and back necklines. The inner dress has a hemmed bottom. The bottom of the outer dress has a ribbed finish. The dresses extend from the shoulder to the ankle area.

Your sample is being returned as requested.

The applicable subheading for style BPK9875, the outer dress, will be 6104.43.1010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s dresses, knitted: of synthetic fibers: containing 23 percent or more by weight of wool or fine animal hair. The duty rate will be 15.7% ad valorem. The applicable subheading for style BKP9875, the inner dress, will be 6104.43.2010, which provides for women’s dresses, knitted: of synthetic fibers: other. The duty rate will be 16.4% ad valorem.

The outer dress falls within textile category designation 436. The inner dress falls in category 636. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
