RE: The tariff classification of a headband from Korea.

Dear Mr. Woodruff:

In your letter dated February 8, 2000 you requested a classification ruling. One of the samples supplied with the ruling request will be returned to you, the other will be retained by Customs.

The submitted samples are of Style 4959 Ribbon HW, which you state is composed of 30% woven elastic nylon fabric, 35% woven nylon fabric, and 35% Polyurethane (PU) imitation leather. The item is a headband, which features a front of PU imitation leather to which is glued a paisley design woven nylon fabric, and a back of black woven elastic nylon fabric. The item is worn around the head and holds the hair in place.

The woven fabrics impart the essential character to the item.

The applicable subheading for the Style 4959 Ribbon HW will be 6217.10.8500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other: Headbands, ponytail holders and similar articles.” The duty rate will be 15% ad valorem.

The Style 4959 Ribbon HW is not subject to quota or the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
