RE: The tariff classification of a “Powerpuff Girls Fur Covered Jewelry Box” from China.

Dear Mr. Charnley:

In your letter dated February 10, 2000, on behalf of Starline Creations, and Tristar Merchandise Inc., you requested a tariff classification ruling.

The sample submitted is a “Powerpuff Girls Fur Covered Jewelry Box”. It is a rectangular shaped box with a hinged lid. The box and lid are made of a cardboard base with the exterior side covered with knit pile fabric. The interior of the box and lid is covered with cardboard that has been flocked with textile fibers. Attached to the interior of the box is a musical electronic disk that is turned on when the lid is raised. Attached to the interior is a plastic figurine of the “Pokemon” character “Pikachu”. The “Pikachu” is attached onto a metal spring that spins around when the box is wound and open. The interior of the lid features a plastic sheeting that reflects as a mirror. The lid exterior features a plastic patch of the “Pokemon” character “Pikachu”. The exterior back has a metal knob for manually winding the musical disk. The box has a metal latch closure. The interior of the box contains no compartments. It measures approximately 3-3/8” x 6” x 2-1/4”.

Also, please note, “Pokemon” is a registered copyright and trademark, and it is required that you obtain written permission from the copyright and trademark owner before importing the “Powerpuff Girls Fur Covered Jewelry Box with the “Pokemon” character “Pikachu” figures.

The applicable subheading for the “Powerpuff Girls Fur Covered Jewelry Box” will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
