RE: The tariff classification of an automotive Console Lid and Shift Boot from Mexico

Dear Mr. Jager:

In your letter dated February 3, 2000 you requested a tariff classification ruling.

You submitted samples of an automotive Console Lid and a Shift Boot. These items are used in the interior of the Toyota Avalon and Toyota Sienna motor vehicles. The Shift Boots are used on both the Avalon and Sienna, but only the Console Lids are used on the Avalon. The Shift Boots are all made of leather, with a covered metal base that will be affixed over the gearshift lever on the steering column; left or right handed. The Console Lid is a cover of the storage compartment between the passenger and driver seats. The Console Lid tilts up and down to gain access to the storage compartment. The Lid includes a latch to keep the Console Lid secure.

The applicable subheading for the Console Lid will be 8708.29.5060, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts and accessories of the motor vehicles of headings 8701 to 8705: Other parts and accessories of bodies (including cabs): Other: OtherOther. The rate of duty will be 2.5% ad valorem.

The applicable subheading for the Shift Boot will be 8708.99.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts and accessories of the motor vehicles of headings 8701 to 8705: Other parts and accessories: Other: Other: Other: OtherOther. The rate of duty will be 2.5% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
