RE: The tariff classification of self-adhesive protective fabric of needleloom construction and made up pads produced from such material, from China.

Dear Mr. Miskill:

In your letter dated January 20, 2000, you requested a classification ruling.

Two representative samples were submitted.

The first item, identified as Shepherd item No. 9433, consists of a rectangular (approximately 6” x 18”) needleloom felt material composed of acrylic man-made fibers. This material contains a light adhesive coating (likely plastics) on one side, and affixed there to, is a protective peel-off paper. This material, once removed from the protective paper, is designed to be cut to the desired shapes and sizes for use as protective pads which will be placed under lamps, figurines, planters, vases and ashtrays, etc., to prevent the possible marring of furniture.

The second item, identified as Shepherd item No. 9423 consists of 46 assorted sizes of essentially the same material which have already been die-cut to a round configuration. Each card contains 16 - 3/8”, 8 - ½”, 10 - 5/8” and 12 - ¾” round disks which can simply be peeled off the card and placed directly under various objects to protect what is underneath.

The applicable subheading for item #9433 will be 5602.10.9090, Harmonized Tariff Schedule of the United States (HTS), which provides for needleloom felt and stitch-bonded fiber fabrics, not laminated, of other than wool or fine animal hair. The duty rate will be 11.4 percent ad valorem.

The applicable subheading for item # 9423 will be 6307.90.9989, HTS, which provides for other made up articles, The duty rate is 7 percent ad valorem.

Item #9433 falls within textile category designation 223. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. There are no textile restraints for item #9423.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
