RE: The tariff classification of a garage door opener from China

Dear Mr. Skidmore:

In your letter dated January 5, 2000 on behalf of New England Door Corp. you requested a tariff classification ruling.

The Superlift garage door opener is an electromechanical device used to automatically raise and lower a garage door in a private dwelling. It basically consists of a ½ horsepower electric motor, a 7 foot aluminum rail containing a screw drive, a lighting and electric control system, and a hand-held remote control transmitter. The radio frequency transmitter generates 433 rolling security codes and has a maximum operating range of 200 feet, and the drive incorporates micro limit switches which indicate the unit’s stop positions. The Superlift lifts and lowers a garage door at the rate of 6 inches per second.

The garage door opener, together with its hand-held remote control transmitter, form a functional unit as described in Note 4 to Section XVI, Harmonized Tariff Schedule of the United States (HTS). Accordingly, the applicable subheading for the Superlift unit and its remote transmitter, imported together, will be 8428.90.0090, HTS, which provides for other lifting, handling, loading or unloading machinery: other machinery: other: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
