RE: The tariff classification of a waterjet cutting system from Taiwan

Dear Ms. Lencer:

In your letter dated August 18, 1999, but not received in this office until January 26, 2000, you requested a tariff classification ruling on behalf of your client, Flow International. Your request included descriptive literature.

The merchandise in question is the Global Waterjet Cutting System, Part #710037-1. The machine is a 2 meter by 2 meter abrasive waterjet "gantry" style cutting table. It is used primarily by job shops for a variety of cutting operations involving mostly glass, metal and ceramic articles and is also widely used in the paper, automotive and aerospace industries. The system incorporates a high pressure pump which forces a powerful jet of water through a hole in an industrial gem embedded in the cutting head for precision cutting jobs.

The applicable subheading for the waterjet cutting system will be 8424.40.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for steam or sand blasting machines and similar jet projecting machines, other. The rate of duty will be free.

Your inquiry does not provide enough information for us to give a classification ruling on the subcomponents of this system, for which you also wanted a ruling. Your request for a classification ruling should include a complete and detailed description of the articles in question, their operation, materials and sole or principal use. When this information is available, you may wish to consider resubmission of your request. If you decide to resubmit your request, please include all of the material that you originally submitted along with the additional information.

For informational purposes only, please be guided by the following. In general, parts and components which are goods included in any of the headings of chapters 84 and 85 are classified in their respective headings. Other parts, if not excluded from section XVI or chapter 84 and if suitable for use solely or principally with a particular kind of machine are classified with that machine. Following these principles, "spare" or replacement parts for the waterjet cutting system are generally classifiable in the provision for parts, other, other in subheading 8424.90.9080, HTS. The rate of duty is also free. However, caution should be exercised that any particular spare or replacement part or component is not excluded from Chapter 84 by operation of Section XVI Note 1 or Chapter 84 Note 1 and not more specifically provided for by Section XVI, Note 2(a).

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
