RE: The tariff classification of women’s jackets from China

Dear Ms. Masco:

In your letter dated December 20, 1999, you requested a classification ruling. The samples that you have submitted will be returned to you under separate cover.

Both of the submitted samples are women’s jackets constructed from 35 percent nylon, 31.4 percent wool, 30 percent silk, 1.6 percent acrylic, 1.6 percent spandex and 0.4 percent polyester woven fabric.

Style 30296 is fully lined and features long hemmed sleeves with a snap closure, a round neckline, shoulder pads, a back vent, two pockets below the waist and a full front opening secured by three hidden snap closures. The jacket extends from the shoulders to approximately the knee.

Style 30310 is fully lined and features long hemmed sleeves, a collar and lapels, shoulder pads, two pockets with flaps below the waist and a full front opening secured by three buttons. The jacket extends from the shoulders to below the hip.

You have indicated that both of these garments will be marketed with coordinating skirts and pants.

The applicable subheading for style 30296 will be 6211.43.0078, Harmonized tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: jackets and jacket-type garments excluded from heading 6202. The duty rate will be 16.4 percent ad valorem.

The applicable subheading for style 30310 will be 6204.33.1000, Harmonized tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-type jackets and blazers: of synthetic fibers: containing 30 percent or more by weight of silk or silk waste. The duty rate will be 7.3 percent ad valorem.

Both styles fall within textile category designation 635. Based upon international textile trade agreements products of China are subject to quota restraints and a visa requirement.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
