RE: The tariff classification of Infants’ PVC Coated Nylon Vests from China

Dear Mr. Law:

In your letter dated November 16, 1999, you requested a tariff classification ruling.

The sample submitted is an Infants’ PVC Coated 100% Nylon Vest. You state the vest will be imported under Style Number 11-342023NO and 12-34202310 in Infant Size Range 0-24 months. The sleeveless vest features a fleece lining, stand up collar, and a full-length zippered front opening. A placket with Velcro closures covers the zippered opening. Two small pockets with Velcro closures are placed on the chest area. Two pockets with zippered closures are located beneath the armholes on the front of the vest. On the back of the vest, a loop is sewn beneath the collar, and two Velcro strips are used to cinch the waist. The sample will be returned to you as requested.

The applicable subheading for the Infants’ PVC Coated 100% Nylon Vest will be 6209.30.3040, Harmonized Tariff Schedule of the United States (HTS), which provides for Babies’ garments and clothing accessories: Of synthetic fibers: Other: Other: Other. The 1999 rate of duty is 16.5%. The rate of duty for 2000 will be 16.4%.

The Infants’ Vest falls within Textile Category Designation 239. Based upon international textile trade agreements, products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check close to the time of shipment, the U. S. Customs Service Textile Status Report, an internal issuance of the U. S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
