RE: The tariff classification of Bethanechol chloride (CAS # 590-63-6) from Italy and Lidocaine Base USP (CAS # 137-58-6) from Spain, all imported in bulk form

Dear Ms. von Doehren:

In your letter dated October 20, 1999, you requested a tariff classification ruling.

Bethanechol chloride, also known as 2-[(Aminocarbonyl)oxy]-N,N,N-trimethyl-1-propanaminium chloride, is an acyclic carbamate salt indicated for use as a cholinergic. Lidocaine Base USP, also known as Acetamide, 2-(diethylamino)-N-(2,6-dimethylphenyl)-, is a cyclic amide indicated for use as an anesthetic (topical).

The applicable subheading for Bethanechol chloride, imported in bulk form, will be 2924.10.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for Carboxyamide-function compounds; amide-function compounds of carbonic acid: Acyclic amides (including carbamates) and their derivatives; salts thereof: Other: Other..... Pursuant to General Note 13 to the Harmonized Tariff Schedule, this product will be free of duty. The rate of duty in 2000 will remain the same.

The applicable subheading for Lidocaine Base USP, imported in bulk form, will be 2924.29.5700, Harmonized Tariff Schedule of the United States (HTS), which provides for Carboxyamide-function compounds; amide-function compounds of carbonic acid: Cyclic (including carbamates) and their derivatives; salts thereof: Other: Aromatic: Other: Drugs: Diethylaminoacetoxylidide (Lidocaine).. The rate of duty will be free. The rate of duty in 2000 will remain the same.
