RE: The tariff classification of hat, headbands and a kerchief from China.

Dear Ms Segro:

In your letter dated November 5, 1999 you requested a classification ruling.

Five samples were submitted with your request. Style 680401263, Cabanna Hat is composed of woven 100% cotton fabric. It has a six panel crown and approximately a 3 ¾” brim. You state Style 680401262, Pin Up Sub Hat is composed of circular sewed straw strips. It has a flat top crown and approximately a 2½ “ brim. Style 680401261, Seran Head Band, is composed of woven 100% cotton fabric with two fabric ties at the back. Style 680401272, Shanti Kerchief is composed of knit crocheted 100% cotton fabric. It is triangular in shape and has two fabric ties. Style 650401278, Fuji Headband is composed of woven 100% cotton fabric with elastic at the back.

The applicable subheading for style 680401263 and will be 6505.90.2060, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted,whether or not lined or trimmed: Of cotton flax or both: Not knitted: certified hand-loomed and folklore products; and headwear of cotton. Other.” The duty rate will be 7.8% ad valorem for 1999 and 7.7% for the year 2000.

The applicable subheading for style 680401262 will be 6504.00.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, plaited or made by assembling strips of any material, whether or no lined or trimmed: Of vegetable fibers, of unspun fibrous vegetable materials, of paper yarn or of any combination thereof: Sewed.” The duty rate will be 6.2% ad valorem and will remain the same for the year 2000.

The applicable subheading for styles 680401261 and 650401278 will be 6217.108500, Harmonized tariff schedule of the United States (HTS), which provides for “Other made up clothing accessories; parts of garments or of clothing accessories; other than those of heading 6212: accessories: Other: Headbands, ponytail holders and similar articles.” The duty rate will be 15% a valorem and will remain the same for the year 2000.

The applicable subheading for style 680401272 will be 6505.90.1540, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted,whether or not lined or trimmed: Of cotton flax or both: Knitted, Of cotton Other: Other.” The duty rate for 1999 will be 8.2% ad valorem and 8.1% for the year 2000.

Styles 680401263, 680401261, 680401272 and 650401278 fall within textile category designation 359. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
