RE: The tariff classification of hats from China.

Dear Ms. Segro:

In your letter dated November 5, 1999 you requested a classification ruling.

Five samples were submitted with your request. Style 650401269, Floppy Hat is composed of woven 100% cotton fabric. The item has a flat crown and approximately a 3” brim. Style 680401260, Hippie Reversible Hat is composed of woven 100% linen on one side and the reverse side is woven cotton fabric. Style 650401252, Reversible Hat is composed of woven 100% cotton fabric. It has a flat top, 2” brim and a mesh lining. Style 680401273, Ixus Visor is composed of woven 100% cotton fabric, and it is designed with an adjustable strap at the back. Style 680401258, Astanga Hat is composed of knit 100% cotton fabric.

The applicable subheading for styles 650401269 and 650401252 will be 6505.90.2060, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted,.or other textile fabric,whether or not lined or trimmed: Other: Of cotton, flax or both: Not knitted: Certified hand-loomed and folklore products; and headwear of cotton, Other.” The duty rate will be 7.8% ad valorem for 1999 and 7.7% ad valorem for the year 2000.

The applicable subheading for style 680401260 will be 6505.90.2590, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted,or other textile fabric,whether or not lined or trimmed: Other: Of cotton, flax or both: Not knitted: Other, Other.” The duty rate will be 7.8% ad valorem for 1999 and 7.7% ad valorem for the year 2000.

The applicable subheading for style 680401258 will be 6505.90.1540, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted,or other textile fabric,whether or not lined or trimmed: Other: Of cotton, flax or both: Knitted, Of cotton: Other.” The duty rate will be 8.2% ad valorem for 1999 and 8.1% ad valorem for the year 2000.

The applicable subheading for style 680401273 will be 6505.90.2545, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted,or other textile fabric,whether or no lined or trimmed: Other: Of cotton, flax or both: Not knitted: Other, visors, and other headgear of cotton which provides no covering for the crown of the head.” The duty rate will be7.8% ad valorem for 1999 and 7.7% ad valorem for the year 2000.

The styles 650401269, 650401252, 680401258 and 680401273 fall within textile category designation 359 and style 680401260 falls within textile category designation 859. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
