RE: The tariff classification of floor Torx fastener blanks from Brazil.

Dear Mr. McCombs:

In your letter dated November 11, 1999, on behalf of your client Camcar Division of Textron Inc., Decorah, IA, you requested a tariff classification ruling .

You stated that the product is a floor Torx fastener blank which will be threaded, plated and heat treated, after they are imported into the United States. Its dimensions are 5/16” x 2” and made of 1022 low carbon steel. Its head shape is round. When finished, it will be used in the floor of truck/trailer and truck/van bodies. The finished screw will have 18 threads to the inch and a tri-lobular thread forming point.

The General Rules for Interpretation (GRI) 2(a) states that any reference in a heading to an article shall be taken to include a reference to that article incomplete or unfinished. This includes articles imported unassembled or disassembled. Noting that the blank will be threaded, plated and heat treated after importation, your merchandise falls into this category.

The applicable subheading for floor Torx fastener blanks will be 7318.15.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers, (including spring washers) and similar articles of iron or steel: threaded articles: other screws and bolts, whether or not with their nuts or washers: having shanks or threads with a diameter of more than 6 mm: other: other. The general duty rate will be 8.5% ad valorem.

Articles classifiable under subheading 7318.15.8080, HTS, which are products of Brazil may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB" then search for the term "GSP".

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
