RE: The tariff classification of a mini notebook necklace from China.

Dear Mr. Rider:

In your letter dated October 6, 1999, you requested a tariff classification ruling.

The submitted sample, LDK-06, is Amelia’s mini notebook necklace. The item is a printed version of a girl’s book, with a 28” nylon cord that enables it to be worn as a necklace. The book measures 1½” x 1¾” and has a paperboard bound cover containing 18 pages. Although the item is an actual book, the print is too small to be read. Therefore, the item will be considered a pendant, to be worn for adornment.

Your sample is being retained for official purposes.

The applicable subheading for the mini notebook necklace will be 7117.90.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for imitation jewelry: other: other: valued over 20 cents per dozen pieces or parts: other: other. The rate of duty will be 11% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
