RE: The tariff classification of a clip photo holder from Taiwan

Dear Ms. Balice:

In your letter dated October 12, 1999, you requested a tariff classification ruling.

The sample you submitted is a clip photo holder (item number 26597), a decorative stand that will be used to display a photograph in the home. It is composed of a steel wire extending vertically from a 1-inch, round base made of polyresin. There is an alligator clip at the top of the wire to hold the photo. The clip photo holder measures approximately 5 inches in height.

The applicable subheading for the holder will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for statuettes and other ornaments, and parts thereof, of base metal, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
