RE: The tariff classification of a snack food from Germany.

Dear Mr. Bettendorf:

In your letters dated August 30, 1999, and October 5, 1999, you requested a tariff classification ruling.

The sample submitted with your first letter was examined and disposed of. Erdnuss Locken (Peanut Curls) is a snack food composed of 61 percent corn grits, 30 percent peanuts, 6.5 percent, 1.8 percent salt, and less than one percent spice. The corn grits are mixed with water into a paste, extruded, cut into pieces, cooled, dried, coated with a mixture of crushed peanuts, vegetable fat, and spice, and put up in bags containing 250 grams, net weight.

The applicable subheading for the Peanut Curls will be 1905.90.9030, Harmonized Tariff Schedule of the United States (HTS), which provides for bread, pastry, cakes, biscuits and other bakers’ wares, whether or not containing cocoaother othercorn chips and similar crisp savory snack foods. The rate of duty will be 5.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
