RE: The tariff classification of three women’s knit pullovers from Hong Kong

Dear Ms. Pettit:

In your letter dated October 5, 1999 you requested a tariff classification ruling.

You submitted three samples of women’s 55% ramie, 45% cotton, knit pullovers. The outer surface of the pullovers measures more than 9 stitches per 2 centimeters in the horizontal direction. Style number 9337 features a V-neckline with embroidered flowers, short sleeves with turn back cuffs, and a ribbed bottom. Style number 9575 features a boat neckline, long sleeves with a ribbed finish, and a ribbed bottom. The front panel has decorative embroidered designs. Style number 9588 is a one-piece pullover with front vest-like flats which simulates a two-piece twin set. The garment features a round neckline, long hemmed sleeves, two attached vest-like flaps that form a V-neckline with a tie closure and a hemmed bottom. Embroidered flowers are on the front necklines.

The applicable subheading for the three pullovers will be 6110.90.9090, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s pullovers, knitted: of other textile materials: other: other: other. The duty rate will be 6% ad valorem.

The three pullovers fall within textile category designation 838. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
