RE: The tariff classification of handbags from China.

Dear Mr. Kobs:

In your letter dated October 8th, 1999, you requested a classification ruling for handbags from China.

The samples submitted with your request are handbags designed to carry money, keys, and small accessories on a daily basis.

Style #LH1000A/B/C/D measures approximately 9 1/2" in width by 8" in height by a 3 3/4" gusset and has an exterior surface of 100% polyester. The interior of the bag is lined and contains a zippered back wall pocket. The top opening of the bag is secured by a zippered closure. There is an auxiliary zippered compartment on the front exterior that contains multiple credit card slots, which are concealed by a flap with a hook and loop closure and placed between two open pouches. A shoulder strap is permanently attached to the bag.

Style #LM1052A/B/C/D measures approximately 9 1/2" in width by 7" in height and has an exterior surface of 100% polyester. The interior of the bag is lined and contains a back wall zippered pocket. A full-width zippered closure secures the top opening of the bag. Featured on the front exterior of the bag is a zippered, lined, auxiliary compartment. A shoulder strap is permanently attached to the top exterior sides of the bag.

Style #LH1404A measures approximately 11" in height by 9 1/4" in width by a 2 3/4" gusset and has an exterior surface of 100% nylon. The interior of the bag is lined and contains a zippered pocket. The front of the bag features an open pocket secured by a front flap with a hook and loop closure. A zippered compartment is placed beneath the front flap on the front exterior. A shoulder strap, adjustable by means of hook and loop closures, is permanently attached to the rear of the bag.

Style #LH1404B/C/D measures approximately 6 3/4" in width by 8" in height by a 2 3/4" gusset. The interior of the bag is lined and contains a zippered back wall pocket. A front flap with a hook and loop closure secures the top opening of the bag. Two D-rings are affixed to the bottom rear exterior of the bag and a belt loop is affixed to the top rear exterior of the bag. A detachable shoulder strap is attached to the top of the bag.

The applicable subheading for the #LH1000A/B/C/D, #LM1052A/B/C/D, #LH1404A, and #LH1404B/C/D will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapwith outer surface of textile materials, other, other, other, of man-made fibers. The duty rate will be 18.8% ad valorem.

Items classifiable under HTS subheading 4202.22.8050 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
