RE: The tariff classification of a 5pc stainless steel bar set from china.

Dear Mr. Kwok:

In your letter dated September 28, 1999 you requested a tariff classification ruling.

A NY ruling E84211 was issued on August 08, 1999 which classified the 5pc bar set under subheading 8211.93.0000 as being last in the tariff. In your letter of September 28, 1999 you raise the question of which item in the bar set appears last in the tariff.

Upon further review this office would concur that the ice tongs appear last in the tariff based on GRI 3©. Due to the clerical error this ruling amends NY ruling E84211.

The applicable subheading for the 5pc stainless steel bar will be 8215.99.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for Spoons, forks, ladles, skimmers, cake-servers, fish-knives, butter-knives, sugar tongs, and similar kitchen or tableware, and base metal parts thereof:

Other: Other: Other (including parts). The rate of duty will be 5.3% ad valorem.

This ruling is being issued under the provisions of Part 177of the Customs Regulations (19 C.F.R. 177).
