RE: The tariff classification of three men's jackets, a man's padded sleeveless jacket and a man's pair of trousers from Bangladesh or the People's Republic of China

Dear Ms. Schott:

In your letter dated September 22, 1999, you requested a classification ruling.

The samples submitted, item numbers 0112, 0113, 0115, 0116 and 0132 are five men's QT series "Mossy Oak" garments used for hunting. Each garment is constructed of an outershell composed of a micro fleece knit 100% polyester tricot 50D/72F fabric which has a polyurethane lamination on the inner surface and is treated on the face with a durable water repellant. Each shell fabric is lightly brushed and has a heat-transfer camouflage pattern print on the face.

Item number 0112, "Chill Cutter Vest", is a hip-length padded sleeveless jacket which is lined with a woven 100% nylon fabric that is quilted to a nonwoven 100% polyester 100GM "Thinsulate" insulation. The padded sleeveless jacket has a stand-up collar, oversized armholes and a full front opening secured by a zipper closure that extends to the top of the garment's collar. An overlapping flap with five snaps covers the zipper area. The garment has two side seam pockets at the waist, an inner pocket and elasticized capping at the bottom hem. An embroidered patch featuring the "Mossy Oak" logo is on the left chest. The "Mossy Oak" tradename is printed on the front placket.

Item number 0113, "Chill Cutter Jacket", is a hip-length jacket that is lined with a woven 100% nylon fabric which is quilted to a nonwoven 100% polyester 100GM "Thinsulate" insulation. The jacket has a stand-up collar and a full front opening secured by a zipper closure that extends to the top of the garment's collar. An overlapping flap with five snaps covers the zipper area. The jacket has two front handwarmer pockets. The handwarmer pockets hang freely at the bottom and have two half snaps. The jacket has two front bellows pockets below the handwarmer pockets. The bellows pockets also have two half snaps. The half snaps on the bottom portion of the handwarmer pockets can attach to the half snaps on the top portion of the bellows pockets forming a flap closure to secure the bellows pockets. Each bellows pocket has elasticized sections on the inner surface that can hold bullets. The jacket has an inner pocket secured by a "VELCRO"-type fastener, long sleeves with a snap closure and elastic on the cuffs and an elasticized waistband. An embroidered patch featuring the "Mossy Oak" logo is on the left chest.

Item number 0115, "Raintamer Jacket", is a jacket lined with a mesh 100% polyester fabric in the body and with a woven 100% nylon fabric in the sleeves. The jacket has a detachable hood that is held to the jacket by five snaps. The hood has a drawcord tightening and a "VELCRO"-type fastener at the chin. The jacket is hip-length and has a stand-up collar and a full front opening secured by a zipper closure. An overlapping flap with five snaps covers the zipper area. The jacket has two front slash pockets at the waist, long sleeves with elasticized cuffs and an elasticized waistband. An embroidered patch featuring the "Mossy Oak" logo is on the left chest.

Item number 0116, "Raintamer Pant", is a pair of trousers that is lined with a woven 100% nylon fabric. The trousers have an elasticized waistband with a drawcord tightening. There are two side seam zippered pockets and a right rear zippered pocket below the waist. The rear pocket also has an embroidered patch featuring the "Mossy Oak" logo. Each trouser leg has an 18-inch zipper opening at the bottom, which is secured by a tab with a "VELCRO"-type fastener.

Item number 0132, "Extreme Jacket", is a jacket lined with a 100% polyester finely knit fabric which is napped on the inside and outside surfaces. The lining is quilted in a diamond pattern to a nonwoven 100% polyester 150GM "Thinsulate" insulation. The jacket has a stand-up collar and a full front opening secured by a zipper closure that extends to the top of the garment's collar. An overlapping flap with six snaps covers the zipper area. The jacket has a zippered pocket on the left chest and two front double entry bellows pockets secured by a flap with two snap closures. The right bellows pocket has elasticized sections on the inner surface that can hold bullets. The jacket has long hemmed sleeves with a tab secured by a "VELCRO-type fastener at the bottom, ribbed-knit fabric storm cuffs, a self-fabric textile loop below the back yoke and an elasticized waistband. An embroidered patch featuring the "Mossy Oak" logo is on the left chest.

The samples are being returned to you.

The applicable subheading for item numbers 0113, 0115 and 0132 will be 6113.00.9025, Harmonized Tariff Schedule of the United States (HTS), which provides for garments, made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907: other coats and jackets: other: men's or boys'. The duty rate will be 7.4 percent ad valorem.

The applicable subheading for item number 0116 will be 6113.00.9044, Harmonized Tariff Schedule of the United States (HTS), which provides for garments, made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907: other trousers, breeches and shorts: other: men's or boys'. The duty rate will be 7.4 percent ad valorem.

The applicable subheading for item number 0112 will be 6113.00.9084, Harmonized Tariff Schedule of the United States (HTS), which provides for garments, made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907: other, other: men's or boys' other. The duty rate will be 7.4 percent ad valorem.

Item numbers 0113, 0115 and 0132 fall within textile category designation 634. Item number 0116 falls within textile category designation 647. Based upon international textile trade agreements products of Bangladesh and the People's Republic of China are presently subject to quota restraints and the requirement of a visa.

Item number 0112 falls within textile category designation 659. Based upon international textile agreements products of the People's Republic of China are presently subject to quota restraints and the requirement of a visa. Products of Bangladesh are not presently subject to quota restraints but a visa is required.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
