RE: The tariff classification of eyeglass retainer strap from Taiwan

Dear Ms. Balk:

In your letter dated October 15, 1999, on behalf of your client Boise Marketing Services, Inc., you requested a tariff classification ruling.

The submitted sample is a eyeglass retainer strap composed of a narrow strip of laminated fabric. The strap is constructed by laminating fabric on both sides of a sheet or strip of neoprene rubber. The eyeglass retainer is then fabricated by folding the strip up at both ends and sewing the sides together creating a tube two inches long on each end. These tubes provide the mechanism for attaching the eyeglass earpieces to the retaining strap. The retaining strap measures approximately 14.5 inches by 7/8 inch.

The applicable subheading for the eyeglass retainer strap will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns, other, other, other, other, other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
