RE: The tariff classification of boys’ knit pajamas from Korea and the Philippines.

Dear Ms. Murphree:

In your letter dated September 23, 1999, you requested a tariff classification ruling. As requested, your samples will be returned.

Style 353592 and 353601 are boys’ knit pajamas which consist of pullover pajama tops and long leg pajama bottoms. The pajamas will be imported in boys’ sizes XXS-XXL (corresponding to sizes 2-14). You have stated that the pajamas will be packaged, priced, and sold as a set and will be sold in sleepwear departments.

Style 353592 is constructed from 100 percent polyester, finely knit jersey fabric. The pajama top has a rib knit crew neckline; long sleeves with rib knit cuffs; and a straight, hemmed bottom. The pajama bottoms have a fabric covered, tunnel elastic waistband and hemmed leg openings. There is contrast color piping on the sleeves and on the outer portion of each leg.

Style 353601 is constructed from 100 percent polyester, finely knit jersey fabric. The pajama top has a rib knit crew neckline; long, hemmed sleeves; and a straight, hemmed bottom. There is a screen printed logo on the chest and on the left sleeve. The pajama bottoms have a fabric covered, tunnel elastic waistband with a drawstring and hemmed leg openings. There is a screen printed logo on the right leg. The applicable subheading for Styles 353592 and 353601 will be 6107.22.0025, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ ... nightshirts and pajamas ... knitted or crocheted: nightshirts and pajamas: of man-made fibers: boys’: other. The duty rate will be 16.5 percent ad valorem.

Styles 353592 and 353601 fall within textile category designation 651. Based upon international textile trade agreements, products of Korea and the Philippines are subject to visa requirements and quota restraints.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
