RE: The tariff classification of footwear from China.

Dear Ms. Wagner:

In your letter dated August 30, 1999 you requested a classification ruling for an item which you refer to as style CSP shoe protector. You have not provided a sample, however you have provided a catalog page which pictures the item and describes it as being included in a full line of side-split cowhide welding garments. The CSP shoe protector is specifically identified as a cowhide leather shoe protector with self grip back fastener, under shoe strap. In a telephone conversation with this office you stated that the item is designed to protect welders feet and shoes from sparks.

The CSP shoe protector is made of leather, extends above the ankle and although not possessing an outer sole, it does have an adjustable strap which secures the protector under the foot.

The applicable subheading for the CSP shoe protector will be 6406.99.60, Harmonized Tariff Schedule, (HTS), which provides for parts of footwear; removable insoles, heel cushions and similar articles; gaiters, leggings and similar articles, and parts thereof, of leather. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
