RE: The tariff classification of various cloths from China.

Dear Ms. Tang:

In your letter dated July 29, 1999 you requested a classification ruling.

You submitted samples of four cloths, which you state are composed of 55 percent linen and 45 percent cotton fabric. The first cloth is a red colored shop towel that is constructed from an osnaburg fabric. It measures 14 inches by 17 inches and the edges are hemmed with an overlock stitch. The second cloth referred to as a detailing towel is constructed from terry fabric. Three edges of the cloth are hemmed and the fourth features a selvage edge. The third cloth is a duster constructed of woven flannel fabric. Both sides of the fabric are slightly napped. The cloth measures 14 inches by 24 inches and the edges are finished with a red overcast stitch. The cloth is yellow in color. The last cloth is constructed from knit fabric and it measures 12 x 15 inches. All of the edges are finished with an overlock stitch.

The applicable subheading for the shop towel will be 6307.10.2015, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: other shop towels dedicated for use in garages, filling stations and machine shops: other. The duty rate will be 7.9 percent ad valorem. The applicable subheading for the other three cloths will be 6307.10.2030, HTS, which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: otherÂother. The duty rate will be 7.9 percent ad valorem.

The shop towel falls within textile category designation 863. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

Presently, subheading 6307.10.2030, HTS, is not assigned a textile category and items classified therein are not subject to quota and visa requirements.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
