RE: The tariff classification of unfinished flags from China.

Dear Mr. Lichstein:

In your letter dated May 19, 1999 you requested a tariff classification ruling. The sample is being returned to you as requested.

The submitted sample is an unfinished flag measuring 24 inches by 26 inches. It is constructed of 100% filament polyester plain woven fabric. The edges of the flag have been finished by hemming. At the top of the flag a sleeve approximately 2.75 inches in diameter has been created by folding down the upper edge of the fabric and hemming it. Two small tabs of woven fabric 2 inches by 1 inch have been sewn on the interior of the sleeve to facilitate the flags attachment to a flag pole. The unfinished flags will be imported blank and will be finished in the United States by printing any one of a number of decorative motifs onto the flag.

The applicable subheading for the unfinished flag will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns, other, other, other, other, other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
