RE: The tariff classification of girls’ garments from Hong Kong, China, Sri Lanka or the Philippines.

Dear Ms. Hodur:

In your letter dated May 14, 1999, you requested a classification ruling on behalf of The Calvin Klein Kids line. The submitted samples will be returned as per your request.

Six garments were provided for review. Style 23b019 is a girls’ camisole style undershirt constructed of a cotton knitted fabric with shoulder straps made of a scollop trimmed elasticized band which continues around the underarms and rounded neckline and back. The garment also features a tiny oval plaid fabric cutout sewn below the center of the neckline and a hemmed bottom. Style 23b020 is a coordinating girls’ bikini panty featuring a scollop trimmed elasticized waistband and leg openings, a sewn-in crotch panel and a tiny plaid bow sewn below the center of the waistband.

Style 23b022 is a girls’ camisole style undershirt constructed of a printed cotton knitted fabric with shoulder straps made of an elasticized band which continues around the underarms and rounded neckline and back. The garment features a hemmed bottom. Style 23b023 is a coordinating girls’ bikini panty featuring an elasticized waistband and leg openings which are high cut, and a sewn-in crotch panel. Style 23b024 is the coordinating girls’ full cut panty brief version of 23b023.

Please note that style 23b018 is being retained by Bruce Kirschner pending additional information from your office.

The applicable subheading for styles 23b019 and 23b022 will be 6109.10.0037, HTS, which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of cotton . . . women's or girls': underwear. The rate of duty will be 18.8 percent ad valorem.

The applicable subheading for styles 23b020, 23b023 and 23b024 will be 6108.21.0020, HTS, which provides for Women's or girls' slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles, knitted or crocheted: Briefs and panties: Of cotton: girls’. The duty rate will be 7.8 percent ad valorem.

All styles fall within textile category designation 352. Based upon international textile trade agreements products of Hong Kong, China, Sri Lanka or the Philippines are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
