RE: The tariff classification of a woman’s skirt and cardigan-like garment from Turkey or Thailand.

Dear Ms. Windham:

In your letter dated May 12, 1999, you requested a classification ruling for two garments. The samples are being returned, as you requested.

Style 3209 is a woman’s skirt constructed from 95% cotton, 5% rayon knit fabric. The full-length skirt features an adjustable drawstring waist; a kangaroo pocket at the front; and a hemmed bottom with side slits extending upward approximately 14 inches.

Style 3302 is a woman’s cardigan styled garment constructed from 95% cotton, 5% rayon knit fabric. The garment features a full front opening with button closure; a hood with a drawstring; patch pockets on both sides of the front opening; and a drawstring tightening at the bottom.

You have described these garments as “Basic After Bathwear” and have indicated that they will be advertised as garments to be worn after the shower or bath in a manner similar to a robe. Notwithstanding these comments, the garments are not considered robes of heading 6108, and therefore, they will be classified under the headings appropriate for the specified garments.

The applicable subheading for the style 3209 will be 6104.52.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for skirtsknitted or crocheted: of cottonwomen’s. The duty rate will be 8.6 percent ad valorem.

The applicable subheading for style 3302 will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirtsand similar articles, knitted or crocheted: of cottonwomen’s. The duty rate will be 18.6 percent ad valorem.

Style 3209 falls within textile category designation 342; style 3302 falls within textile category designation 339. Based upon international textile trade agreements products of Turkey and Thailand are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
