RE: The tariff classification of ladies’ garments from Hong Kong.

Dear Ms. York:

In your letter dated March 12, 1999, you requested a classification ruling. The provided samples will be returned as per your request.

Two samples were provided for review. Style 17-2676k is a ladies’ 95% cotton 5% spandex tank top with a shelf bra. The garment features 1/4 inch wide elastic shoulder straps, a rounded neckline in front and back, elasticized trim around the armholes and across the back, and a hemmed bottom.

Style 37-2517k is a ladies’ camisole constructed of a transparent nylon raschel lace-like fabric. The garment features a shelf bra, adjustable elasticized spaghetti straps, elasticized trim across the scoop front, straight back and around the armholes, and a hemmed bottom.

The applicable subheading for style 17-2676k will be 6109.10.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: Of cotton . . . Women's or girls': Other: Tank tops: Women's. The duty rate will be 18.8 percent ad valorem.

The applicable subheading for style 37-2517k will be 6109.90.1065, HTS, which provides for T-shirts, singlets, . . . and similar garments knitted or crocheted: of man-made fibers, women's or girls': tank tops and singlets, women's. The general rate of duty will be 33 percent ad valorem.

Style 17-2676k falls within textile category designation 339 and style 37-2517k falls within textile category designation 639. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
