RE: The tariff classification of Resimene 891, Resimene BM 5503, Resimene BM 5905 and Resimene 7383 from Canada.

Dear Ms. Pierce:

In your letter dated March 26, 1999, you requested a tariff classification ruling.

Based on the technical literature submitted, Resimene 891 is a butylated melamine-formaldehyde solution composed of approximately 70 percent resin solid, 20 percent n-butal alcohol, 10 percent xylene and 2 percent formaldehyde, by weight. Resimene BM 5503 is a butylated menlamine-formaldehyde resin solution composed of approximately 75 percent resin solids, 25 percent n-butyl alcohol and 1.5 percent formaldehyde, by weight. Resimene BM 5905 is a butylated melamine-formaldehyde resin solution composed of approximately 56-60 percent resin solution, 40 percent n-butyl alcohol and 1.5 percent formaldehyde, by weight. Resimene 7383 is a butylatedmelamine-formaldehyde resin solution composed of approximately 67 percent resin solids, 29 percent n-butanol and 4 percent formaldehyde, by weight.

The applicable subheading for the Resimene 891, Resimene BM 5503, Resimene BM 5905 and Resimene 7383 will be 3909.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Amino-resins, phenolic resins and polyurethanes, in primary form: Melamine resins. The rate of duty will be 6.5 percent ad valorem.
