RE: The tariff classification of womens knit garments from Hong Kong

Dear Ms. Knipper:

In your letter dated March 26, 1999, on behalf of your client, Magaschoni Apparel Group, you requested a classification ruling.

Style 27968 is a womans skirt of 80% silk/20% cashmere which extends below the knee and features two side seams; an elastic waistband; and a flared hemmed bottom.

Style 27978 is a womans dress of the same fabric which extends below the knee and features an opening that is unfinished and rolled slightly to form a straight neckline; short rib sleeves; and a hemmed bottom.

The applicable subheading for the skirt will be 6104.59.4000,Harmonized Tariff Schedule of the United States (HTS) which provides for skirts and divided skirts: of other textile materials: containing 70 percent or more by weight of silk or silk waste. The duty rate will be 3.4 percent ad valorem. The applicable subheading for the dress will be 6104.49.1000,Harmonized Tariff Schedule of the United States (HTS) which provides for dresses: of other textile materials: containing 70 percent or more by weight of silk or silk waste. The duty rate will be 3.4 percent ad valorem.

Style 27968 falls within textile category 742 and style 27978 falls within textile category 736. Based upon international textile trade agreements, such products of Hong Kong are not subject to quota and the requirement of a visa.

Your samples will be returned.

Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
