RE: The tariff classification of Dual Temperature Probe Calibrators

Dear Ms. Daniel:

In your letter, dated March 24, 1999, you requested a tariff classification ruling.

This device, which you produce in the USA, has two small thermal wells. It can heat the hot well to a very precise temperature between ambient and 257 degrees Fahrenheit and maintain it there and, conversely, cool the cold well between ambient and 23 degrees. Although the hot well might be considered by itself a type of laboratory electric oven in HTS 8514, the combination of the hot and cold wells in one device makes it clear that its only purpose is to provide a standard for the calibration of temperature probes used in thermometers or similar devices, not to affect the properties of the item placed within, which is the normal use of an oven.

The applicable subheading for this item will be 9025.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for, inter alia, accessories for thermometers and pyrometers.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
